Applicability of The Agreement

This agreement (“user agreement”) incorporates the terms and conditions for Where Travel Design Private Limited (WTDPL) and its brand Where Travel Design to provide services to the person (s) (“the User”) intending to purchase or inquiring for any products and/ or services of WTDPL by using WTDPL’s websites or using any other customer interface channels of WTDPL which includes its sales persons, offices, call centers, social media, advertisements, information campaigns etc. Both User and WTDPL are individually referred as ‘party’ to the agreement and collective referred to as ‘parties’.

User’s Responsibility of Cognizance

The Users availing services from WTDPL shall be deemed to have read, understood and expressly accepted the terms and conditions of this agreement, which shall govern the desired transaction or provision of such services by WTDPL for all purposes, and shall be binding on the User. All rights and liabilities of the User and/or WTDPL with respect to any services to be provided by WTDPL shall be restricted to the scope of this agreement.

WTDPL reserves the right, in its sole discretion, to terminate the access to any or all WTDPL websites or its other sales channels and the related services or any portion thereof at any time, without notice, for general maintenance or any reason what so ever.

In addition to this Agreement, there are certain terms of service (TOS) specific to the services rendered/ products provided by WTDPL like the Experiences, holiday packages and tailor made travel etc. Such TOS will be provided/ updated by WTDPL which shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail. The User shall be required to read and accept the relevant TOS for the service/ product availed by the User. Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, flights, hotel reservations, packages, etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Service Provider with whom the User elects to deal, including terms and conditions set forth in a Service Providers’ fare rules, contract of carriage or other rules.

WTDPL’s Services are offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be applicable from time to time. For the removal of doubts, it is clarified that availing of the Services by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not avail WTDPL’s Services.

In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any other WTDPL document, then these terms shall control.

Third Party Account Information

By using the Account Access service in WTDPL’s websites, the User authorizes WTDPL and its agents to access third party sites, including that of Banks and other payment gateways, designated by them or on their behalf for retrieving requested information. While registering, the User will choose a password and is responsible for maintaining the confidentiality of the password and the account.

The User is fully responsible for all activities that occur while using their password or account. It is the duty of the User to notify WTDPL immediately in writing of any unauthorized use of their password or account or any other breach of security. WTDPL will not be liable for any loss that may be incurred by the User as a result of unauthorized use of his password or account, either with or without his knowledge. The User shall not use anyone else’s password at any time.

Confidentiality

Any information which is specifically mentioned by WTDPL as Confidential shall be maintained confidentially by the user and shall not be disclosed unless as required by law or to serve the purpose of this agreement and the obligations of both the parties therein.

Website And Mobile App Usage

Your use of any information or materials on the website is entirely at your own risk, for which WTDPL shall not undertake any liability. It shall be your own accountability to ensure that any products, services or information available through our website, meet your explicit specifications.

You are restrained from altering, duplicating, distributing, transmitting, reproducing, publishing, licensing or selling any information, software, products or services acquired from this website. Duplication of content from the website is forbidden which is in accordance with the copyright notice and forms a part of the Terms of Use. Additionally, WTDPL reserves private rights to modify, revise, and delete any of the contents without giving prior notice to any person.

Usage Of The Mobile Number Of The User By WTDPL

WTDPL may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the User at the time of booking; WTDPL may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS and/ or voice call by WTDPL is (a) upon the request and authorization of the User, (b) “transactional” and not an “unsolicited commercial communication” as per the guidelines of Telecom Regulation Authority of India (TRAI) and (c) in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The User will indemnify WTSPL against all types of losses and damages incurred by WTDPL due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the User on WTDPL with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

Onus Of The User

WTDPL is responsible only for the transactions that are done by the User through WTDPL. WTDPL will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User.

The accuracy of the data and bookings have to be cross verified by the user. The user warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction.

Insurance

Unless explicitly provided by WTDPL in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation/option of the user and WTDPL doesn’t accept any claims arising out of such scenarios.

Insurance, if any provided as a part of the service/ product by WTDPL shall be as per the terms and conditions of the insuring company. The User shall contact the insurance company directly for any claims or disputes and WTDPL shall not provide any express or implied undertakings for acceptance of the claims by the insurance company.

Force Majure Circumstances

The user agrees that there can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If WTDPL is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to its customers or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The user agrees that WTDPL being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds.

The User agrees that in situations due to any technical or other failure in WTDPL, services committed earlier may not be provided or may involve substantial modification. In such cases, WTDPL shall refund the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of WTDPL against such non-provision of services or deficiencies. Additional liabilities, if any, shall be borne by the User.

WTDPL shall not be liable for delays or inabilities in performance or nonperformance in whole or in part of its obligations due to any causes that are not due to its acts or omissions and are beyond its reasonable control, such as acts of God, fire, strikes, embargo, acts of government, acts of terrorism or other similar causes, problems at airlines, rails, buses, hotels or transporters end. In such event, the user affected will be promptly given notice as the situation permits.

Without prejudice to whatever is stated above, the maximum liability on part of WTDPL arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any loss, damage or additional expense whatsoever beyond the amount charged by WTDPL for its services.

In no event shall WTDPL and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the WTDPL website(s) or any other channel . Neither shall WTDPL be responsible for the delay or inability to use the WTDPL websites or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the WTDPL website(s), or otherwise arising out of the use of the WTDPL website(s), whether based on contract, tort, negligence, strict liability or otherwise. WTDPL is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages.

Safety Of Data Downloaded

The User understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the Service is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.

Nevertheless, WTDPL will always make its best endeavors to ensure that the content on its websites or other information channels are free of any virus or such other malwares.

Feedback From Customer And Solicitation

The User is aware that WTDPL provides various services like hotel bookings, car rentals, Experiences, and would like to learn about them, to enhance his / her travel experience. The User hereby specifically authorizes WTDPL to contact the User with offers on various services offered by it through direct mailers, e-mailers, telephone calls, short messaging services (SMS) or any other medium, from time to time. In case that the customer chooses not to be contacted, he /she shall write to WTDPL for specific exclusion at support@wheretraveldesign.com or provide his / her preferences to the respective service provider. The customers are advised to read and understand the privacy policy of WTDPL on its website in accordance of which WTDPL contacts, solicits the user or shares the user’s information.

Proprietary Rights

WTDPL may provide the User with contents such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws.

The User may use this material only as expressly authorized by WTDPL and shall not copy, transmit or create derivative works of such material without express authorization.

The User acknowledges and agrees that he/she shall not upload post, reproduce, or distribute any content on or through the Services that is protected by copyright or other proprietary right of a third party, without obtaining the written permission of the owner of such right.

Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.

Visa Obligations of the User

The travel bookings done by WTDPL are subject to the applicable requirements of Visa which are to be obtained by the individual traveler. WTDPL is not responsible for any issues, including inability to travel, arising out of such Visa requirements and is also not liable to refund for the untraveled bookings due to any such reason.

Indemnification

The User agrees to indemnify, defend and hold harmless WTDPL and/or its affiliates, their websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by WTDPL and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.

The user shall be solely and exclusively liable for any breach of any country specific rules and regulations or general code of conduct and WTDPL cannot be held responsible for the same.

Right To Refuse 

WTDPL at its sole discretion reserves the right to not to accept any customer order without assigning any reason thereof. Any contract to provide any service by WTDPL is not complete until full money towards the service is received from the customer and accepted by WTDPL.

Without prejudice to the other remedies available to WTDPL under this agreement, the TOS or under applicable law, WTDPL may limit the user’s activity, or end the user’s listing, warn other users of the user’s actions, immediately temporarily/indefinitely suspend or terminate the user’s registration, and/or refuse to provide the user with access to the website if:

  • The user is in breach of this agreement, the TOS and/or the documents it incorporates by reference
  • WTDPL is unable to verify or authenticate any information provided by the user; or
  • WTDPL believes that the user’s actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or WTDPL.

WTDPL may at any time in its sole discretion reinstate suspended users. Once the user have been indefinitely suspended the user shall not register or attempt to register with WTDPL or use the website in any manner whatsoever until such time that the user is reinstated by WTDPL.

Notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, WTDPL reserves the right to recover any amounts due and owing by the user to WTDPL and/or the service provider and to take strict legal action as WTDPL deems necessary.

Right To Cancellation In Case Of Invalid User Information

The User expressly undertakes to provide to WTDPL only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from WTDPL.

In case WTDPL discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him/her, WTDPL in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, WTDPL shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services.

The User unequivocally indemnifies WTDPL of any such claim or liability and shall not hold WTDPL responsible for any loss or damage arising out of measures taken by WTDPL for safeguarding its own interest and that of its genuine customers. This would also include WTDPL denying/cancelling any bookings on account of suspected fraud transactions.

Severability

If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

Headings

The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of WTDPL Websites or its partner websites or any provision hereof in any manner whatsoever.

In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular WTDPL website, then these terms shall control.

Relationship

None of the provisions of any agreement, terms and conditions, notices, or the right to use this website by the User contained herein or any other section or pages of WTDPL Websites or its partner websites, shall be deemed to constitute a partnership between the User and WTDPL and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way.

Updation Of The Information By WTDPL

User acknowledges that WTDPL provides services with reasonable diligence and care. It endeavors its best to ensure that User does not face any inconvenience. However, at some times, the information, software, products, and services included in or available through the WTDPL websites or other sales channels and ad materials may include inaccuracies or typographical errors which will be immediately corrected as soon as WTDPL notices them. Changes are/may be periodically made/added to the information provided such. WTDPL may make improvements and/or changes in the WTDPL websites at any time without any notice to the User. Any advice received except through an authorized representative of WTDPL via the WTDPL websites should not be relied upon for any decisions.

Modification Of These Terms Of Use

WTDPL reserves the right to change the terms, conditions, and notices under which the WTDPL websites are offered, including but not limited to the charges. The User is responsible for regularly reviewing these terms and conditions.

Jurisdiction

WTDPL hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. WTDPL considers itself and intends to be subject to the jurisdiction only of the courts of New Delhi, India.

Responsibilities Of User Vis-a-Vis The Agreement

The User expressly agrees that use of the services is at their sole risk. To the extent WTDPL acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the standards of services provided by the service providers. In no circumstances shall WTDPL be liable for the services provided by the service provider. The services are provided on an “as is” and “as available” basis. WTDPL may change the features or functionality of the services at any time, in their sole discretion, without notice. WTDPL expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, which the User obtains from WTDPL or through the services shall create any warranty not expressly made herein or in the terms and conditions of the services. If the User does not agree with any of the terms above, they are advised not to read the material on any of the WTDPL pages or otherwise use any of the contents, pages, information or any other material provided by WTDPL. The sole and exclusive remedy of the User in case of disagreement, in whole or in part, of the user agreement, is to discontinue using the services after notifying WTDPL in writing.

Usage Of Customer’s Holiday Pictures

Any picture or video shared by the customers during or post the trip in the support groups or emails or social media, will be used in the social media platform to engage the audience. Outbound Tours | Booking & Confirmations

DEFINITIONS 

  • Client means person(s) in whose name or on whose behalf the booking has been made. 
  • WTD means Where Travel Design Private Limited. 
  • Independent Contractors means hotelier/hotel owner, owner of any airlines or shipping company or railway ferryboat owner/operation, coach owner/operation, or any other person or organization which has been selected to render services to the client. 
  • Outbound tour/ Tour arrangement means a tour operated by WTD which is operated by WTD outside India and includes, but is not limited to, brochure tours, special tours, packages, cruise, sight-seeing, carnival, cosmos, star cruise etc. 
  • Tour Cost means cost of all the services availed by the client for his outbound tour. 
  • Brochure means catalogue/leaflet/e-mail or any other document containing the details about the itinerary/activities on the outbound tour. 
  • Infant means a person below the age of 2 years and child means a person above the age of two and below the age of twelve years.

BROCHURE/E-MAIL/DOCUMENT INFORMATION 

  • All information given in the brochure is based on the information available at the time of publication. WTD reserves the right to change any information contained in the brochure before or after booking the outbound tour due to any event(s) beyond the control of WTD. 
  • In case WTD becomes aware of any change before the departure for the outbound tour, WTD will take all reasonable steps to notify the client before the departure for the outbound tour. In the event of WTD becoming aware of the changes post the departure for the outbound tour, the WTD tour manager or local representative will inform the client about the change. 
  • Some specific terms and conditions are mentioned against the respective outbound tour itinerary in the brochure/website. Those terms and conditions also form part of the booking terms and conditions. 
  • No claim of the client against any change in the brochure/e- mail/document regarding the outbound tour shall be entertained and client acknowledges that such changes are due to reasons beyond the control of WTD. 

MEALS AND SPECIAL REQUESTS 

  • The menus are pre-set for meals on the outbound tour. The nature of meals is clearly indicated in the brochure. WTD would not entertain a request for a special meal nor guarantees a special diet to the client except to the extent mentioned in the brochure. 
  • WTD reserves the right to change the menu if circumstances necessitate such a change. In the event that the client is not able to avail the meals in the menu for any reason attributable to the client, no claim can be made for the unutilized meal against WTD.
  • Client acknowledges that hotels worldwide serve breakfast at 6 am (local time) and hotels do not pack and deliver breakfast. The meal has to be consumed when served. If the client misses breakfast due to him/her catching a flight or any other reason, no claim for the same shall be entertained.
  • WTD may, in its sole discretion, entertain the requests for special meals / room allocations subject to such requests given in writing by the client. WTD would take all the necessary steps to ensure that these special requests are honoured. However, in the event that such special requests are not honoured, WTD would not be liable for any claim in this regard by the client. Extra cost, if any, for special meals have to be borne by the client.
  • Client shall be responsible to bear the additional charges of any special meal if purchased by him/her and shall not be entitled to recover the same from WTD. 
  • In no event where the client fails to avail the meal due to the
    fault of WTD, WTD’s entire liability will exceed more than the proportionate amount that the client had paid WTD for the • meal while booking the outbound tour. The proportionate amount shall be decided by WTD and shall not be subject to any dispute by the client.

HOTELS

  • WTD takes all reasonable steps at the time of selecting the hotels that form a part of the outbound tour. The selection is based on strong internal assessment of the respective hotels and the hotels selected are usually the best in the respective categories. WTD endeavours to provide details of the hotel to the client in advance vide proposed itinerary. However, WTD reserves the right to change hotels before booking subject to availability or any other reason and no claim with regard to the star category or type of the hotel shall be entertained by WTD after booking.
  • WTD would not be held liable or to make good any inconvenience or discomfort caused to the client due to but
    not limited to the insufficient services provided at the hotel. WTD acts as an agent between the client and the hotel and would under no circumstances be held responsible for inadequate services provided by the hotel.
  • The client would be liable to make good any damage(s) caused by any act of him/her (willful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. WTD would not, in any way, intervene in the same.
  • Client agrees and acknowledges that the standard check-in and check-out time of the hotels worldwide are as follows: 

For South East Asia: Check-in: 2 PM (local time) Check-out: 11 AM or 12 NOON (local time) 

Client further acknowledges that during peak seasons (Apr-Jun & Oct-Dec), there may be some delays in the above said check- in/check-out timing and WTD shall in no way be liable for any claims arising from any delays in check-in/ check-out timings.For US, UK and Europe: Check-in: 3 PM (local time), Check- out: 10 AM (local time). Client further acknowledges that during peak seasons (Apr-Jun & Oct-Dec) there may be some delays in the above said check-in/check-out timing and WTD shall in no way be liable for any claims arising from any delays in check-in/ check-out timings.

  • No request for the change of hotel shall be entertained. If client upgrades the hotel or changes the hotel on his own, he/she agrees to bear the charges incurred for change in the hotel and shall not be entitled to claim it from WTD. 
  • Client shall be responsible for his/her own baggage and valuables and WTD shall not be liable for any loss of baggage or theft of client’s articles during their stay in the hotels or any time during the tour.

ITINERARY 

  • WTD shall provide a proposed itinerary to the client before the booking which shall be subject to change for reasons beyond the reasonable control of WTD. The proposed itinerary is only tentative and the booking details and hotel vouchers sent to the client before departure shall be final. 
  • The outbound tour price is subject to increase without any notice if this rate substantially changes prior to departure. The client would be required to pay such increase in the tour cost before the departure. 
  • WTD takes all reasonable steps at the time of finalising the itinerary for the client to ensure that the itinerary is as per the convenience and comfort of the client. However, in the event of a change in the itinerary, WTD would inform the client accordingly before the departure of the client on the outbound tour. 
  • Further, in the event of a change, beyond the control of WTD, in the itinerary of the client post departure for outbound tour, WTD shall inform the client accordingly as and when such a change occurs. WTD shall not be held responsible in any manner whatsoever for any loss that a client might suffer consequent to such a change. 
  • WTD reserves the right to claim any additional expenses on account of delays/changes in the itinerary, caused by any reason whatsoever.
    WTD reserves the right to amend, alter, vary or withdraw any particular departure, excursion or substitute a hotel of similar category if deemed advisable or necessary. 
  • For the convenience of clients, WTD will sometimes amend the itinerary. However, all other services will remain the same. In the event that the client misses out on any activity on the outbound tour due to delay on his part, WTD would not be held liable to refund the money paid for the same or in any other manner whatsoever.
  • WTD will not entertain any change in the itinerary at the request of the client after booking in view that it might disarray the entire tour. However, WTD may, in its sole discretion and subject to availability, provide changes in the itinerary made at the request of the client. Client agrees to pay additional cost incurred due to such change/cancellation.

COACH / SITTING 

  • On the outbound tours, air-conditioned/air-cool luxury coaches are used for transfer purposes including local sight seeing. There are no seat numbers allocated and the clients shall follow instructions of the Tour Manager in this regard. 
  • In case the client is carrying any valuable personal effects, it is advisable not to leave them behind at the time of disembarking/leaving the coach. WTD will not be held responsible or liable in case of loss of such items from the coach. All baggage and personal effects are at all times and in all circumstances the responsibility of the client. 
  • Any damage caused to the coach during travel as a consequence of the actions of the client (willful/negligent), shall be payable by the client and WTD would in no manner whatsoever be liable for the same. 
  • The drivers of the coaches are bound by specific rules like maximum driving hours within a day/during a week, rest period per day/week etc. Clients will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In the event that any of the sightseeing schedules is missed due to delays caused by the client, the same will not be refunded to the client under any circumstances. 
  • In the event of breakdown of any coach or any vehicle arranged for transportation, WTD will provide an alternative within reasonable time. WTD shall not be liable for any delays occurred due to breakdown or traffic jam or for any reasons causing delay in the provision of alternative coach/ vehicle.

TOUR/BOOKING COST 

WTD shall always provide a consolidated invoice of the entire tour cost. WTD in no circumstances whatsoever provides the break–up of the invoice details to the client. 

TIPPING 

  • Tipping is customary (unless otherwise stated in the brochure) in all parts of the world for services rendered (e.g. porters, coach drivers, guides etc). This is however solely at the discretion of the client. 
  • Tipping in Europe is something that is expected of anyone providing you a service, for example, local guides, waiters, tour manager, posters etc. However, it is mandatory to tip the coach driver a nominal amount of 2 Euros for Europe and UK and 2 Dollars for USA per person per day for the duration of the tour. 

CURRENCY AND TRAVELLERS CHEQUES 

  • It is recommended that the client take holiday spending money partly in local currency (i.e. in the currency of the country where he/she is traveling), partly in travellers’ cheques or travel currency card. Traveller’s cheques are a safe way to carry money as they are easily encashable for a small service fee and can be replaced if they are stolen or lost, provided you have the traveller’s cheque numbers and the counterfoil. 
  • Alternatively, the client can carry a Travel Currency Card, which is by far the safest way to carry foreign currency. The card gives anytime access to cash at VISA/VISA PLUS ATMs and in any denominations. This card is also accepted by over 12 Million Visa Electron Merchant Outlets across the world. 

ACCOMMODATION FOR CHILD BELOW 12 YEAR OF AGE 

  • A child below 12 years of age who is booked on the outbound tour paying the special rate without a bed will not be provided with a bed in the hotel while on the outbound tour under any circumstances. 
  • In case the client makes any changes in their accommodation while on the outbound tour, WTD shall not refund or pay compensation in any manner whatsoever. The client would also be liable to pay any additional sum that is required to be paid consequent to the aforesaid changes made in the accommodation.

REGISTRATION/COMMUNICATION OF ANY CHANGE IN THE ITINEARY 

  • In case where the travel agent, through whom the clients have booked the outbound tour, signs the booking form for and on behalf of the client, it shall be deemed and construed that the clients have duly authorized the said travel agent to sign on their behalf. The signing of the booking form by the travel agent would be binding on the client. 
  • Information shall be provided at the contact details provided by the client/client’s travel agent at the time of booking. WTD takes no responsibility for any claims arising out of non- receipt of information if the specified contact number is not reachable or does not belong to the client. 
  • WTD takes no liability for any promises made to the client by the travel agent authorized by the client to make bookings. All products and services are provided as per WTD brochures/e- mail or any other document provided to the client at the time of booking the tour. 

FORFEITURE OF DEPOSITS

  • WTD requires the client to pay non-refundable interest-free booking fee at the time of booking the tour, along with the prescribed booking form duly completed for the outbound tour booked by the client. 
  • In the event that the client cancels the booking or fails to adhere to the tour payment schedule as informed in the documentation check list or in the event that the visa of any country is not granted or the client is unable to travel on the tour booked due to any reason whatsoever, including medical ground or sickness, cancellation charges will apply as communicated to the client by WTD over e-mail.
  • Client acknowledges that booking of air tickets/hotels for a tour may, in some cases, be done parallel to visa processing to ensure the availability and booking as per the proposed itinerary and in the event of any denial/ rejection of visa, WTD shall be entitled to recover any cost incurred in making such bookings by way of deducting cancellation charges as specified hereinabove.
  • Client acknowledges that such charges are just and fair and are deducted towards expenses that WTD incurs towards making bookings at the request of the client and consequent cancellation or non-travel by the client. 

NUMBER OF DAYS OF THE TOUR 

The days and nights as per the itinerary are decided as per the availability of hotels and airlines. No claims regarding full utilization of last day or inclusion in the tour shall be valid. 

CANCELLATION DUE TO VISA REJECTION 

  • All the clients traveling on an outbound tour must be in possession of a valid visa of the country in which the clients would be visiting as a part of the outbound tour. 
  • WTD acts as a facilitator for visa processing and is not responsible for scrutinizing the visa before submitting it to the visa authority. The discretion to grant/reject the visa rests solely with the concerned authority/embassy and WTD will in no way be held responsible in case the visa is refused by the concerned authorities for whatever reason(s). 
  • WTD shall not be held responsible for non-issuance / rejection of visa due to receipt of incomplete/ delayed documents from the client. It is a possibility that the consulate may ask the passenger to appear for a personal interview. This is at the sole discretion of the Consulate / concerned authorities. 
  • Passengers whose visas are not granted by the Singapore/Malaysia/Thailand/ consulates Client must intimate WTD immediately, at which time WTD will deduct applicable cancellation charges towards administrative charges in addition to any additional visa expenses incurred and refund and balance amount. However, if such intimation is not received as aforesaid, cancellation charges will be applicable as per the cancellation rules mentioned hereunder. 
  • WTD will block the bookings or book the tickets in advance and share the booking details once the client’s visa is confirmed, in its sole discretion, to ensure travel on the dates requested by the client. In such case where the visa of the client is not garneted, the associated cancellation charges for booking shall be applicable. 
  • Passengers whose visas are not granted by US / UK / SCHENGEN consulates must intimate WTD immediately, at which time WTD will deduct the applicable cancellation charges towards administrative charges, along with any additional visa expenses incurred and refund and balance amount. However if such intimation is not received as aforesaid, cancellation charges will be applicable as per the cancellation rules mentioned hereunder.

  • WTD shall in no way be held liable for any delay in response from the visa authority about visa acceptance or rejection by the authorities. 
  • WTD shall make best efforts for timely delivery of the passport to the client before the date of departure of the tour. However, WTD shall not be liable for any delays or loss of passport for reasons beyond its control as WTD relies on third party vendors for such services. In the event of any cancellation of tour due to delay in delivery of the passport or rejection of visa, WTD shall be entitled to recover cancellation charges from the client as per the term herein.

TRANSFER FROM ONE TOUR TO ANOTHER 

A transfer from one tour to another prior to the departure of the originally booked tour will be treated as a cancellation of the original tour and would attract the cancellation charges as stated hereunder and a fresh booking would have to be made at the prevalent rates. 

PAYMENTS 

  • Balance payments of the tour cost shall be made as follows: Payment 30 days prior to the outbound tour departure date: Only by cheque/cash/DD

Payment within 30 days from the date of departure of outbound tours: Only by cash/DD 

(If any cheque towards the payment is dishonored, WTD, without notice to the client, shall be entitled to cancel the entire booking without any liability. 

  • Final documents and airline tickets will be delivered (by hand, e-mail or courier) only after the balance payment is made to WTD by the client. PAN Card copy will be required when payments amounting to Rs.25, 000/- or above are made by cash. 

REFUNDS 

  • Refunds (if any) for amendments and / or cancellation will be paid directly to the client for booking made directly with WTD. 
  • Refund (if any) due to visa delay/rejection will be subject to applicable cancellation policy shared with the client by WTD.
  • For booking routed through our Preferred Sales Agent (PSA) or travel agent of the client, the refunds will be routed through them. 
  • The normal time to process the refunds is at least 30 working days. 
  • There is no refund payable for any unutilised services (e.g. Meals, Entrance Fees, Optional Tour, Hotel, Sightseeing etc).
  • The refund for the foreign exchange components of the outbound tour will be refunded in INR only and will be at the prevailing day’s rate of exchange on the date of refund.
  • In the event of any delay in the refund beyond the period specified herein, the entire liability of WTD shall be refund of the said amount with interest calculated at the applicable bank rate till the date the refund is made.

SCOPE OF ACTIVITY 

  • WTD is engaged in the business of travel and holiday organizer and does not control or operate any airline. It does not own or control any shipping company, coach or coach company, hotel, transport, restaurant, kitchen caravan or any other facility or service mentioned in this brochure. 
  • WTD shall not be responsible for any delay, improper services provided by any agency, airline, transport, hotel, any provider of services, for any injury, death, loss or damage which is caused by the act or default of the management or employees of any hotel, airlines, shipping companies, cruise, coach owners/coachoperators/tour operators who are WTD’s independent contractors. 
  • WTD shall not be responsible for any delay or deficiency in services provided by any agency, airline, transport, hotel, any provider of services, and/or any act or actions of co-travelers, co-passengers which may result in injury, damage to the life/limb or property of the client or interfere with enjoying or availing the services to be provided on the outbound tour. 

PROMOTION & DISCOUNT or PRICING POLICY 

  • WTD may, from time to time, launch some promotions/discount offers on the tour package internally or externally through advertisements and some clients in the group tour might receive additional benefits due to entitlement to such promotion/discounts. No claims from clients in the group for such privileges shall lie if they are not entitled for the discounts or eligible under the promotion. 
  • Rate of Exchange taken for computing the cost of tour may vary due to change in ROE. In the event of increase in the ROE taken into account, the cost of tour may be amended and client agrees to pay any increase in the tour cost. 

CONDITIONS OF PASSAGE 

  • The aforesaid conditions are applicable to every client of WTD who books an outbound tour. 
  • In the event of a client booking through WTD, a Tour or Tour Arrangement of any other Tour Operators like Carnival, Cosmos, Star Cruise etc., the “Terms and Conditions” specified by such Tour Operator, including their payment schedule, cancellation, refund etc. shall be applicable, in addition to above mentioned “Terms and Conditions” while determining the contractual relation between the client, the Tour Operator and WTD. 
  • Client agrees that WTD is only acting as a facilitator while booking a Tour Operator and any claims for any refund arising due to cancellation or any other claims against the Tour Operator shall only be made against the said Tour Operator and WTD in no event be held liable for any refund or any other claims whatsoever.

HEALTH AND INSURANCE 

  • It shall be the duty of the client to inform WTD in case the client has any medical history that may affect his ability to enjoy and fully pursue the outbound tour and wherein the interest of the group or any member thereof is prejudicially affected. 
  • WTD reserves the right to ask the client to provide written certification of his medical fitness before departure. In the event that a medical condition has not been disclosed, WTD shall not be liable to provide any assistance or refund the money. 
  • It is mandatory that the client is adequately covered by Overseas Medicaid Insurance Policy and other appropriate insurance policies from the Insurance Company to cover the risk of life, limb and property while on outbound tour. WTD would in no way be responsible for any loss of life or property in any manner whatsoever. 
  • The tour cost would not necessarily include the costs towards the insurance premium. Hence, it is advisable that the client gets insurance cover at their own costs. 
  • In case of any medical emergency to the client during the tour, WTD shall make best effort to provide medical assistance or arrange for travel back home for the said client. Client agrees that in the event that the client is unable to utilize the remaining tour due to sudden illness, he/she shall not be entitled to recover refund for the unutilized part of the tour.

CANCELLATION OF THE TOUR DUE TO MEDICAL ILLNESS 

  • If a client cancels his/her booking before departure on medical grounds, client must provide necessary certificates to WTD. Any waiver or refund of the tour shall be subject to discussions with airlines/hotels and approval from such airlines/hotels. However, WTD does not promise any waiver/refund of the tour cost on medical grounds. 
  • Client acknowledges that as all the bookings are made on group basis and individual cancellations of bookings of any client and receipt thereof shall not be provided and cancellations shall be as per the terms herein. 

CONDITIONS OF TRAVEL 

  • The client will have to strictly follow the Tour Program and return to India as per the validity of the air ticket. There shall be no refund, if the client fails to join the group at the commencement of the tour, or joins the group later or leaves the group before culmination of the tour. It shall be noted that for all purposes, it shall be the responsibility of the client to reach the place of commencement of the tour and register with the representative of WTD at the appointed place, date and time. 
  • In case a client along with his family is compelled to discontinue the tour due to any reason whatsoever including illness, death or loss of passport or any travel documents, no claim shall be entertained for refund of unutilized services. Even if a client is unable to reach the place of commencement of the tour due to any reason whatsoever including loss of baggage or loss of travel documents, his booking shall be treated as “no show” on the tour and 100% cancellation charges will be levied. 
  • If a client avails pre-tour services or part thereof, or the air tickets (cost of which is included in the main tour cost) but fails to join the group for the main tour at the appointed place, or cancels the tour after using the air tickets or pre-tour arrangements or part thereof, it shall be treated as “no show” and there will be no refund whatsoever for the unutilized pre- tour or main tour services. 
  • WTD reserves the right to withdraw tour membership of any client whose behavior is deemed likely to affect the smooth operation of the outbound tour or adversely affect the enjoyment or safety of other passengers and WTD shall be under no liability to any such person. 
  • The immunities provided under this contract shall be available to WTD’s employees, directors, managers, including Tour Managers, Employees, Servants and Agents but not to the Independent Contractors selected by WTD. 
  • Each of these conditions shall be severable from the other and if any provision be invalid, illegal or unenforceable, the remaining provisions shall nevertheless have full force and effect. No liability on the part of WTD arising in any way out of the Contract in respect of any tour, holiday, excursion facilities shall exceed the total amount paid or agreed to be paid for the outbound tour holiday, and shall in no case include any consequential loss or additional expense whatsoever. 
  • It is a condition of booking that the client takes out a Holiday Insurance. 
  • The prices quoted in this brochure have been calculated at the rate prevailing at the time of printing of this brochure. WTD reserves the right to amend the prices published in this brochure in case of currency fluctuations, changes in the various gross rates of exchange, and/or fuel costs, special/high season charge levied by the suppliers, hike in the airline/rail charges before the date of departure and to surcharge accordingly. All such increases in price must be paid for in full before the departure by the client. 
  • If no suit/action is brought against WTD within three months of the last day of the outbound tour, WTD shall be discharged from all liabilities under/or arising out of this contract and the client shall be deemed to have relinquished/abandoned all his rights under or arising from this contract. 
  • If the client books with a travel agent and such booking with that agent includes, but is not limited to, WTD arrangements, the contract is with the client’s travel agent and WTD is a supplier to the client’s travel agent. 
  • In case of publication of any travel scheme offering any discount or benefit by WTD, WTD shall have the sole right to withdraw such a scheme or discount at any time unless a specific assurance of the contrary is published. 

LIABILITY 

  • In the event of WTD exercising its rights to amend or alter any tour or holiday advertised in their brochure/ itinerary after such a tour or holiday has been booked, the client shall have the right: 
  • To continue with the tour or holiday as amended or altered or to accept any alternative tour or holiday, which WTD may offer. 
  • In either of these cases above, the client shall neither be entitled to nor WTD be liable to the client for any damage, additional expenses, consequential loss suffered by him or to pay any amount as refund. In the event that WTD is unable to conduct a particular tour, WTD shall at its own discretion, refund the amount of the cost of the said tour to the client (after deducting the actual expenses incurred by WTD on clients’ booking like visa, insurance premium, POE charges, and other overheads as applicable from case to case) without any interest on the same. The client will not be entitled to make any grievance thereafter in respect of the same. 
  • WTD shall, in no circumstances whatsoever, be liable to the client or any person traveling with him for: 
  • Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage or any kind of theft howsoever caused. 
  • Any act, omission, default of any independent Contractor or other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person traveling with him howsoever caused. 
  • The temporary or permanent loss of or damage to baggage or personal effects howsoever caused including willful negligence on the part of any person. 
  • Loss of baggage by the airlines / coach / cruise / train.
  • Overbooking of seats by the airline.
  • Any delay due to the airline.
  • Failure on the part of airline to accommodate passengers despite having confirmed tickets or change of route.
  • If in the event that the client is booked on a particular airline and the said flight is over booked/cancelled for whatever reason and the client is not allowed/able to board the flight, the client shall not hold WTD responsible for the same and no claim whatsoever can be made by the client against WTD for refund or compensation.
  • For any claims of any dispute with the Tour Manager.
  • In no event shall the entire liability of WTD for any claims directly and indirectly arising out of the tour exceed the total booking amount paid by the client.
  • WTD shall not be held liable for any claims arising due to delay at the airport or if the client has to wait at the airport due to any technical sang or any reasons not attributable to WTD. WTD shall not be liable for making any arrangements, including but not limited to food or any hotel arrangement. 
  • WTD shall not be responsible and / or liable for any damages caused to the client due to reasons beyond the control of WTD (Force Majeure / Vis Majeure). In the event of any cancellation due to Force Majeure events WTD shall not be liable for any refund to the client. 
  • The customer agrees that there can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If WTD is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to its customers or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The client agrees that WTD being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. The maximum liability of WTD in such events will be refund of the booking amount subject to receipt from the airline or providing alternative. 
  • Customer acknowledges that WTD is only a facilitator and any refund for any service(s) which was/were not delivered by the service provider or for any reason for which the Client is entitled for a refund is subject to WTD receiving the amount from the said service provider. Client acknowledges that WTD shall not be held liable for any delay in refund or non-refund of the amount from the service provider. In such events the Client shall directly approach the service provider for any claims. 

LAW & JURISDICTION: 

  • For all complaints, suits, claims or disputes of whatsoever nature relating to any products including Tours by WTD and third party products and tours the courts and tribunals in Delhi, India alone shall have exclusive jurisdiction. All tours are subject to laws, rules of Reserve Bank of India / Government of India. The client shall also refer and abide by the terms and conditions as mentioned in the ‘User Agreement’ and Privacy Policy available on www.makemytrip.com to the extent those terms are applicable to the current transaction.
